Auction Fees: Besides the amount of your bid, you agree to pay a 10% auction fee, as well as all required sales tax and vehicle registration fees(for vehicle purchases only), subject to your place of residency. Sales tax ranges from 8.75% to 9.25% subject to the county where you reside. For Vehicle Purchases: A Processing Fee of $90.00 will also be applied.
Winning Bids: By placing a bid on this website, you agree to purchase the said lot for the amount of your bid, plus applicable fees. Once your bid is confirmed to be the winning bid, you must deposit 25% of bid price or $500.00 minimum (Earnest Money Deposit) immediately. You may pay by cash, credit card, or by cashier's check. You will then have (24) hours or until the next business day to complete your transaction and pay for your purchased lots in full. You will be assessed a $25 per day storage fee if you do not claim your purchased lots within the allowed time period. All outstanding debts thereafter are subject to collection and may be submitted to the District Attorney. In the event that the bidder has defaulted on the auction agreement to pay any open balance due on the bid amount, the bidder agrees and understands that the 25% Earnest Money Deposit shall be retained by the Auction as Liquidated Damages.
All Lots are sold “AS-IS Where Is”. No Warranties expressed or implied. Auction will provide lot description to the best of its knowledge but it is the Bidder’s responsibility to inspect and verify lot information prior to placing any bids.
Auctioneer’s Responsibility: If for any reason whatsoever the Auction fails to deliver any awarded lot, the Auction’s sole liability shall be the return of any deposit or monies paid on such non delivered lot.
Shipping: It is the Buyer’s sole responsibility to pay for and arrange for shipping a vehicle if needed. Auction will work with and accommodate, to its best ability, buyer’s shipping requests. It is recommended that shipping information and costs be researched prior to placing any bids. Failure to obtain shipping is not cause to terminate an auction agreement to buy.
Rights To Suspend or Terminate: You agree that this website, at its own discretion, may terminate any auction or use of the service immediately and without notice if: (a) We believe that you are not abiding by the general rules of this website; (b) You have repeatedly violated a certain term or condition of this agreement; (c) We believe you to be a non-paying bidder.
In most cases, when we suspect foul play we will suspend your account while we investigate further. If our investigation is conclusive then your account with us will be closed.
Your Conduct: You are solely responsible for your actions on this website. You must ensure that your participation in buying a vehicle items does not violate any applicable laws or regulations. By this we mean that you must ensure that you entitled to buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through this service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.
Membership: Membership to this website is only available to those who can legally enter a binding contract. This website does not permit minors (under the age of 18) to register. If any member registers wtih an incorrect age, their account will be terminated immediately.
Disclaimer: This website shall not be responsible for any items sold by auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This website shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained. This website assumes no liability for the content of the listings.
Laws: These terms and conditions shall be governed by the laws of the State of California. By registering herein, you agree to have any dispute resolved by a means of Binding Arbitration.
